Terms of Service

These Terms of Service ("Terms") govern your use of the Private Prompt browser extension and related services ("Service") provided by Private Prompt ("we", "us", "our"). By installing or using the Service, you agree to these Terms.

1. Service Description

Private Prompt is a browser extension that attempts to detect and anonymize personally identifiable information (PII) and other sensitive data in text you submit to AI chatbot services. The extension operates locally within your browser.

2. No Guarantee of Complete Protection

You expressly acknowledge and agree that:

• The Service may fail to detect certain types of sensitive data, including but not limited to: misspelled names, unusual data formats, context-dependent information, data in unsupported languages, newly created data patterns, or information embedded in complex sentence structures.
• The Service may produce false positives, replacing non-sensitive data that matches detection patterns.
• The Service may produce false negatives, failing to detect data that is sensitive in your specific context.
• You remain solely responsible for reviewing all prompts before submission and ensuring that no sensitive data is sent to third-party AI services.
• The Service is an assistive tool, not a replacement for human review and judgment. You should not rely on the Service as your only safeguard for sensitive data protection.

3. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.
• We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, and non-infringement.
• We do not warrant that the Service will detect all sensitive data, that the anonymization will be error-free, or that the Service will meet your specific requirements.
• In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, damage to reputation, regulatory fines, or legal claims arising from data exposure, whether or not we have been advised of the possibility of such damages.
• Our total aggregate liability for any and all claims arising from or related to the Service shall not exceed the amount you have paid to us in the twelve (12) months preceding the event giving rise to the claim, or fifty US dollars ($50), whichever is greater.

4. User Responsibilities

You agree to:

• Review your prompts before submission, even when the Service is active.
• Not rely solely on the Service for compliance with any data protection regulation (GDPR, RODO, CCPA, HIPAA, or other).
• Maintain your own data protection policies and procedures independent of the Service.
• Report any detected failures or bugs in the anonymization to us promptly.
• Not use the Service for any illegal purpose or in violation of any applicable laws.
• Not attempt to reverse-engineer, decompile, or modify the Service.

5. Data Processing

Private Prompt processes all data locally within your browser. We do not:

• Collect, store, or transmit your prompt content to our servers.
• Have access to the data you submit to AI services.
• Store anonymization mappings outside your browser's local storage.

The only data we process on our servers relates to license validation, usage counting (anonymization count per day, not content), and payment processing through Stripe.

6. Subscription and Payments

6.1 Free Plan

The free plan includes up to 10 anonymizations per day with basic detection capabilities. No payment information is required.

6.2 Pro Plan ($8/month)

Provides unlimited anonymizations, advanced detection, custom patterns, and priority support. Billed monthly through Stripe. You may cancel at any time; access continues until the end of the billing period.

6.3 Business Plan ($29/month per seat)

Includes all Pro features plus team management, admin dashboard, API access, and audit logs.

6.4 Refunds

We offer a 7-day free trial for Pro plans. After the trial period, payments are non-refundable, except where required by applicable law. If you experience a technical issue that prevents the Service from functioning, contact us within 30 days for a pro-rata refund.

7. Intellectual Property

The Service, including its code, design, and documentation, is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

8. Indemnification

You agree to indemnify, defend, and hold harmless Private Prompt and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

• Your use of the Service.
• Any data exposure resulting from the Service failing to detect sensitive data.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.

9. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via the extension or email (if provided). Continued use of the Service after changes constitutes acceptance of the updated Terms.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may stop using the Service at any time by uninstalling the extension.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland. Any disputes shall be resolved by the competent courts in Poland.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
